Building Energy Use Benchmarking and Public Disclosure Program

Assembly Bill 802 (Williams, Chapter 590, Statutes of 2015) mandates the establishment of a new statewide building energy use benchmarking and public disclosure program. AB 802 revises PRC Section 25402.10 to require utilities to provide energy consumption data for covered buildings to the building owners upon request, and requires the Energy Commission to establish a building energy use benchmarking and public disclosure program for certain buildings. Developing the New Program

The time-of-transaction building energy use disclosure program (commonly referred to as Assembly Bill 1103) ended December 31, 2015. For historical information on that program visit

There is no statewide energy use disclosure requirement for 2016. Throughout 2016, Energy Commission staff will prepare for and conduct a rulemaking to develop regulations and establish the infrastructure for the new statewide benchmarking program mandated by Assembly Bill 802. Staff anticipates that regulations for the new program will become effective in 2017.

On November 10, 2015, Energy Commission staff conducted a pre-rulemaking scoping workshop to gather public input on implementing the benchmarking provisions of AB 802. Staff anticipates holding more workshops before and during the rulemaking process. Stakeholder participation and feedback is encouraged and appreciated.
